What information do you need before the survey?

Will my Commercial EPC be lodged on the official register?

Yes. Once the assessment has been completed and the EPC produced, the certificate is lodged on the official Government Energy Performance of Buildings Register.

Do MEES rules apply to commercial properties?

Yes. The Minimum Energy Efficiency Standards (MEES) can apply to privately rented non-domestic property.

Commercial landlords therefore need to consider both the EPC rating of the building and the MEES requirements when letting qualifying commercial premises. Exemptions can apply in certain circumstances.

Do I need a TM44 air-conditioning inspection?

TM44 inspections are separate from Commercial EPC assessments.

Air-conditioning systems with a combined effective rated output of more than 12kW can fall within the air-conditioning inspection requirements.

If your commercial property has air-conditioning equipment and you’re unsure whether an inspection is required, this should be checked separately from the EPC.

Commercial EPC and MEES Non-Compliance Risks

Commercial property owners and landlords need to be aware that EPC and Minimum Energy Efficiency Standards (MEES) requirements are enforceable.

Where a Commercial EPC is legally required, failing to make a valid EPC available to a prospective buyer or tenant can result in a financial penalty. For non-domestic buildings, the penalty is calculated according to the property’s rateable value, with a minimum penalty of £500 and a maximum of £5,000.

Commercial landlords can face substantially higher penalties where the MEES regulations apply.

Since 1 April 2023, qualifying privately rented non-domestic properties generally need an EPC rating of at least E, unless a valid exemption applies.

Where a landlord unlawfully lets a sub-standard commercial property in breach of MEES for less than three months, the financial penalty can be the greater of £5,000 or 10% of the property’s rateable value, up to a maximum of £50,000.

For a breach lasting three months or more, the penalty can be the greater of £10,000 or 20% of the property’s rateable value, up to a maximum of £150,000.

This is why it is important for commercial landlords to understand both the EPC rating of their building and whether the MEES requirements apply to the property.
